Data Protection Statement

We are committed to protecting your personal data. In this Data Protection Statement, we explain how we collect and process personal data. However, the description does not claim to be exhaustive. Personal data means all information that relates to a specific or identifiable person.

This data protection declaration also applies in particular to the website/internet page www.haeny.com. By accessing or using the website, you agree to the collection and use of your personal data as described in this Data Protection Statement.

We are committed to handling your personal data in a responsible manner. Consequently, we consider it a matter of course to comply with the legal requirements of the Swiss Confederate Data Protection Act (DSG), the Ordinance to the Confederate Data Protection Act (VDSG), the Telecommunications Act (FMG) and other provisions of Swiss data protection law. With regard to personal data of users from the European Union, we shall also – to the extent necessary – maintain such data in accordance with the provisions of the EU Basic Data Protection Regulation (GDPR).

Please note that the following information is verified and amended from time to time. We therefore recommend that you view this data Protection Statement regularly. The details of the data processed and how it is used depend largely on the services agreed to and/or used.

1. Description and scope of data processing

1.1 General logging of access to the website
We collect a set of general data and information every time a data subject or automated system accesses the website. This general data and information is stored in the log files of the server. The following may be logged:

an internet protocol address (IP address),
the date and time of access to the website,
the exact subpage that was accessed on our website,
the internet page from which you reached our website (also known as the referrer),
the browser used and its version,
and the operating system used for access.

We process the above-mentioned data for the following purposes:

to ensure trouble-free opening of a connection to the website,
to optimise the contents of our website for you,
and to ensure system security and stability.

These points are in your and our legitimate interests. In addition, we may also use this data to comply with our legal commitments in cooperation with law enforcement agencies.

1.2 Contact form, requesting information, agreeing an appointment, online job applications
If you use the form on the website or email to contact us, or apply for a vacancy, we will process the data you provide to comply with your request. Email traffic is not encrypted. This is your risk.

1.3 Newsletter
You have the possibility to subscribe to our newsletter via our website. If you subscribe to the newsletter distribution list, we will store the data you enter a server. We use this data exclusively for distributing the email newsletter. To analyse system performance, the data records are used for statistical evaluations. We do not pass on your data to third parties and do not use the data for any other purposes of our own. The registration system with an additional confirmation message containing a link to a final registration ("double opt-in") ensures that you explicitly requested the newsletter, and that you give your consent to the storage and processing of your email address for the purpose of distributing the newsletter and for statistical evaluations to analyse system performance.

You can cancel your subscription to the newsletter at any time via a link in the newsletter. We will retain your data until you cancel the newsletter.

1.4 In the scope of business relations
Furthermore, we process your personal data which we receive from our customers, our business partners and other stakeholders in the scope of our business relationship with them.

To the extent permitted, we also source certain data from publicly accessible sources (e.g., debt enforcement register, land registers, commercial register, media, internet), e.g., in the context of a job application. In addition to the data you give us directly, this means personal data that we receive about you from third parties (e.g., authorities, business partners, employers), in particular information from public registers, information that we gather in connection with official and court proceedings, information in connection with your professional roles and activities (so that we can, for example, with your assistance, concluded and process business transactions with your employer), information about you in correspondence and from meetings with third parties, information about you that is given to us by people close to you (e.g., family, consultants, legal representatives, employers) so that we can conclude or process contracts with or involving you (e.g., references, powers of attorney, salary administration), your address and, if applicable, interests and other socio-demographic data (for marketing purposes).

2. Purpose and legal basis of data processing

2.1 To fulfil contractual obligations
Data is processed within the framework of fulfilment of our contracts with our customers or for the implementation of pre-contractual measures carried out on request. The purposes of data processing are primarily driven by the service we provide. The personal data collected in this way is used for the complete processing of our service, including any subsequent warranty claims, technical administration, etc.

Further details on data processing purposes can be found in the pertinent contractual documents and terms and conditions.

2.2 In the scope of balancing interests
Where necessary and permissible, we process your data beyond the actual fulfilment of the contract in order to protect our own legitimate interests or those of third parties. Examples:

  • Consultation of and data exchange with rating agencies and other third parties (e.g., debt collection registers, former employers)
  • Examination and optimisation of procedures for the analysis of requirements for the purpose of direct customer contact as well as collecting personal data from publicly accessible sources for the purpose of customer acquisition
  • Advertising and marketing (including the organisation of events) as well as market and opinion research
  • Assertion of legal claims and defence in legal disputes
  • Ensuring IT security and IT operation
  • Prevention and investigation of criminal offences
  • Measures for business management and further development of services and products and our website
  • Purchase and sale of business units, companies or parts of companies and other transactions under company law and the associated transfer of personal data as well as measures for business management

2.3 Based on your consent
If you have given us your consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent. Consent granted can be revoked at any time – regardless of when it was given. The revocation of consent does not affect the legality of the data processed up to the time of revocation.

2.4 Due to legal requirements or in the public interest
Furthermore, as a company we are subject to various legal obligations in connection with which we must process and store your data.

3. Storage of your personal data

We only store your data for as long as necessary to use the tracking services within the scope of our legitimate interest and to perform the services you have requested or for which you have given your consent.

We continue to process and store your data as long as it is necessary for the fulfilment of our contractual and legal obligations. Please note that by law, certain data must be retained for a certain period of time.

4. Transfer of the data to third parties in Switzerland and abroad

In the course of our business activities and for the purposes set out in this Data Protection Statement, we also disclose information to third parties, where permitted and where we believe it is appropriate, either because they process the data for us or because they wish to use the data for their own purposes.

In particular, your personal data may be disclosed to third parties who act for us or on our behalf to enable them to further process the data in accordance with the purpose(s) for which the data was originally collected or for other legally permissible purposes, for example, to provide services (e.g. banks, insurance companies); this includes order processors (such as IT providers, newsletter service providers), to evaluate the benefits of this website, for marketing purposes, data management or technical support.

Personal information entered by you may also be transferred to third parties in the event that business units, the Company or parts thereof, including the related customer data, are sold, assigned or transferred. Personal data may also be disclosed to third parties if we are required to do so by law, court order or official regulations or if this is necessary to support criminal or legal investigations or other legal investigations or proceedings in Switzerland or abroad.

These third parties are partly in Switzerland, but can be anywhere in the world, e.g., service providers we use such as Microsoft, SAP etc. If the level of data protection in a country is deemed to be inappropriate for Swiss circumstances or within the meaning of the EU Data Protection Basic Regulation, we will ensure – as required by law – by means of appropriate contracts that your personal data is protected at all times in accordance with Swiss guidelines or the EU Data Protection Basic Regulation, or we will rely on the legal exceptions to the above-mentioned rules for consent, the execution of contracts, the establishment, exercise or enforcement of legal claims, overriding public interests, the published personal data or because it is necessary to protect the integrity of the persons concerned.

5. Security

We use appropriate technical and organisational security measures that we consider appropriate to protect your data stored by us from manipulation, partial or complete loss and unauthorised access by third parties. Our security measures are continuously adapted in line with technological developments. Absolute protection cannot be guaranteed. However, our website and other systems are protected by technical and organisational measures against loss, destruction, access, modification or processing of personal data. We also take our own internal corporate data protection very seriously. Furthermore, access to personal data is only granted to the extent necessary.

6. Your rights

When using this website you have several options. You can choose not to provide any personal information at all by not filling out any forms or data fields on our website and not using any of the personalised services available. If you choose to provide personal data or make it available to us as part of our business relationship, you have the right of access, correction, restriction, deletion, transferability and objection to your personal data, to the extent provided by applicable law.

Every data subject also has the right to pursue his or her claims through the courts or to lodge a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Confederate Data Protection and Information Commissioner.

7. Contact person

All inquiries, explanations and queries regarding the use of data should be directed to infohaeny.com or to the address in the imprint.

8. Cookies/tracking and other technologies in connection with the use of our website

8.1 Use of cookies
Our website uses cookies. Our interest in optimising our website must be deemed justified. Cookies are text files that are stored in the internet browser or by the internet browser on the user's computer system. The use of cookies serves to make your user experience more enjoyable.

We use session cookies to identify you as a returning visitor to the individual pages of our website. These are automatically deleted when you leave our site. In addition, we also use temporary cookies which are stored on your end device for a certain defined period of time to improve your user experience. If you visit our website again in order to use our services, we will automatically identify you as a returning visitor, and identify the entries and settings you made so that you do not have to enter these again.

We also use cookies in order to record the use of our website statistically and to optimise our offering and, where necessary, to display information specifically tailored for you. These cookies enable us to automatically identify you as a returning visitor to our website. The cookies are automatically deleted after a defined period of time.

The personal data of users collected in this way is pseudonymised by technical precautions. Therefore, it is no longer possible for us to link the data with the visiting user. The data is not stored together with other personal data belonging to users. If you disable cookies for our website, you may be unable to use all functions of the website to their full extent.

In our newsletters we partly, and insofar as permitted, also incorporate visible and invisible image elements; by retrieving them from our servers we can determine whether and when you opened the email, so that we can measure and better understand how you use our offerings and thus tailor them more appropriately to your needs. You can block this in your email program.

By using our website and agreeing to receive newsletters, you agree to the use of these technologies. If you do not want this, please configure your browser or email program accordingly.

8.2 Google Analytics
We use Google Analytics on our website; we cannot use this to measure and evaluate the use of our website on a personal basis. This is a service provided by a third party. Google LLC, the operator of Google Analytics, is based in the USA (www.google.com). For this purpose, we use permanent cookies set by the service provider. The service provider does not receive any personal data from us, but can track your use of the website, combine this information with data from other websites which you have visited and which are also tracked by the service provider. The service provider may use this information for its own purposes (e.g., for targeting advertising). If you have registered with the service provider yourself, the service provider is also aware of your identity. Any processing of your personal data by the service provider is then carried out under the responsibility of the service provider in accordance with its Data Protection Statement. The service provider only informs us how our respective website is used (it does not provide information about you personally).

8.2.1 Google reCAPTCHA
reCAPTCHA is a Google-owned service (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) that protects websites from spam and misuse. It uses progressive risk analysis techniques to distinguish between humans and bots. The data captured by Google reCAPTCHA is subject to the Google Privacy Policy and Terms of Service Google, and is used to provide, maintain and improve the reCAPTCHA service as well as for general security purposes (it is not used for Google’s personalised advertising).

8.3 Social media
8.3.1 Embedding of YouTube videos
We have embedded YouTube videos in our website; the videos are stored on www.youtube.com and can be played back directly from our website. When you visit pages of our website equipped with a YouTube plugin, a connection to the YouTube servers is established. This tells the YouTube server which specific page of our website you visited. In addition, if you are logged into your YouTube account, you would allow YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this assignment possibility by logging out of your account in advance. Please note that we have no influence on the processing of personal data by YouTube and therefore accept no liability for the processing of personal data by YouTube.

8.3.2 Embedding of Google Maps
On our website we use the offerings provided by Google Maps. This allows us to display interactive maps directly on the website and enables you to use the map function in a convenient way.

Clicking on the maps will connect you to Google Maps and the Google DoubleClick network. This tells Google Maps that you have accessed the matching subpage of our website. In addition, the data referred to in Section 4 is transmitted. Clicking on the button may trigger further data processing operations which we as website operator cannot influence. Therefore, please visit the Google Maps website in advance to discover the details of the Data Protection Statement provided there.

8.3.3 Links
If you use the external "LinkedIn" link provided on our website, this Data Protection Statement does not extend to this link. Therefore, please check the appropriate website for the Data Protection Statement provided there in advance.

9. Advice for children and parents

Our website targets an adult audience. Minors, especially children under the age of 13, are prohibited from submitting personal information about themselves to us or registering for our newsletter. If we discover that such data has been transmitted to us, it will be deleted from our database. The child's parents (or legal representative) can contact us to request deletion or to unsubscribe. For this purpose we need a copy of an official document.

Exclusion of liability

Claims for damages by the user, for whatever legal reason, due to defects in the software or due to violation of other obligations are excluded. In particular these are: incorrect design of lifting systems, pumps and other system components, incorrect data, drawings, characteristic curves or price quotations.
